Legal Defense Fund formed for SB1070 counter-litigation

A legal defense fund has been created to support the state's border sheriffs regarding SB 1070 and the possibility of counter litigation.

Described as non-partisan, non-profit, the legal defense fund was established to assist Sheriffs Larry Dever and Paul Babeu.

Dever, with Cochise County, and Babeu, with Pinal County, announced this privately funded defense fund via a live radio press conference on Newstalk 550 KFYI in Phoenix.

The fund was created to help the sheriffs "defend themselves against pro-amnesty interest groups and federal government lawsuits filed to prevent Arizona law enforcement officials from implementing SB 1070, Arizona's new illegal immigration law to explore possible counter-litigation," said a joint statement issued Thursday by the Cochise and Pinal County Sheriff's Offices and the Rose Law Group.

"Dever's county borders Mexico. Babeu's county is a major corridor for human and drug smuggling," the statement said.

"Both men are strong 1070 advocates, having served on the frontlines of the illegal immigration crisis and defend the American border against the stream of illegal immigration-fueled criminal activity passing through their counties daily, for more than a decade."

Dever and Babeu have retained Conservative Attorney Jordan Rose and her firm Rose Law Group, pc, to defend their offices against federal litigation and explore any and all opportunities to counter-sue the federal government.

"We are grateful to be able to provide the Sheriffs with the most aggressive and creative legal counsel as the lives of their men and women are on the line each day trying to enforce our laws," Rose said Thursday.

The Cochise and Pinal County Sheriffs Offices are named specifically in the lawsuit filed recently by the American Civil Liberties Union (ACLU).

Dever said, "I have spent 30 years defending this border against both criminal and economic attacks against the United States. To sue my office, for defending this nation and our local, state, and federal laws is despicable."

"Inaction is not an option," added Babeu. "Local law enforcement has long successfully enforced local, state, and federal laws. Carving an exception for immigration is unacceptable."

The Legacy Foundation, an Iowa-based, Conservative 501c3, will provide funding for the legal defense that views Arizona's SB 1070 debate as a national issue.

The mission of the Legacy Foundation is to focus on state level policy matters, including constitutional and civil rights.
