FORMAL BOARD MEETING HELD 0N

TUESDAY, MAY 16, 2006

A regular board meeting of the Cochise County Board of Supervisors was held on Tuesday, May 16, 2006 at 9:00 a.m. in the Board of Supervisors' Hearing Room, 1415 Melody Lane, Building G, Bisbee, Arizona. In attendance were Patrick Call, Chairman; Paul Newman, Vice-Chairman; Richard Searle, Member; Jody Klein, County Administrator; Jim Vlahovich, Deputy County Administrator; Charles Irwin, Deputy County Attorney; Katie Howard, Clerk of the Board.

PLEDGE OF ALLEGIANCE

THE ORDER OR DELETION OF ANY ITEM ON THIS AGENDA IS SUBJECT TO MODIFICATION AT THE MEETING

ROLL CALL - Chairman Call, Vice-Chairman Newman and Supervisor Searle were in attendance.

CALL TO THE PUBLIC (MATTERS RELATED TO COUNTY GOVERNMENT - LIMIT OF 3 MINUTES PER PERSON OR AT THE DIRECTION OF THE CHAIRMAN) - Chairman Call opened the Call to the Public. Mr. Mike Jackson addressed the Board objecting to the review process conducted for Phase 1 of the Building Codes and stated that Phases 2 and 3 could not be implemented without violating Board action taken at the December 14, 2004 meeting. There being no other members of the public wishing to address the Board, Chairman Call closed the Call to the Public.

REPORT BY MR. JODY KLEIN, COUNTY ADMINISTRATOR ON RECENT AND PENDING COUNTY MATTERS - Mr. Klein reported that there is a lot of time being devoted to budget issues, budget meetings and preparation of materials for the scheduled May 23rd budget overview presentation to the Board. He also mentioned that he would be meeting with the various stakeholders of the criminal justice system on Wednesday afternoon to discuss Bisbee space needs and would be preparing a memo to the Board describing alternatives. He advised the Board that there is also a meeting on Thursday with TischlerBise regarding impact fee studies and a meeting with Pima County representatives, also on Thursday, to discuss flood control projects.

CONSENT

BOARD OF SUPERVISORS

ITEM 1-ACCEPT THE APPLICATION FOR A WATER FRANCHISE FROM LUCKY HILLS WATER COMPANY AND SET A PUBLIC HEARING FOR JUNE 20, 2006 AT 9:00 A.M.

ITEM 2-APPROVE THE MINUTES OF THE FORMAL BOARD OF SUPERVISORS' MEETING OF MAY 9, 2006.

FINANCE

ITEM 3-DEMANDS Warrant No.14407 through 14733 were issued in the amount of $1,740,071.99 No voided warrants. Pursuant to A.R.S. §11-217(C), the published minutes shall include all demands and warrants approved by the Board in excess of one thousand dollars except that multiple demands and warrants from a single supplier or individual under one thousand dollars whose cumulative total exceeds one thousand dollars in a single reporting period shall also be published. Issued warrants are listed as an attachment at the end of the minutes. Vice-Chairman Newman made a motion to approve Consent Agenda Items 1through 3. The motion was seconded by Supervisor Searle and carried unanimously.

PUBLIC HEARINGS

BOARD OF SUPERVISORS

ITEM 4-APPROVAL OF AN APPLICATION FOR A SERIES #13 (DOMESTIC FARM WINERY) LIQUOR LICENSE SUBMITTED BY MS. JACQUELYN TAYLOR COOK FOR CORONADO VINEYARDS, INC. LOCATED AT 2909 EAST COUNTRY CLUB DRIVE, WILLCOX, ARIZONA. Supervisor Searle made a motion to approve the application for a Series #13 Liquor License (Domestic Farm Winter) submitted by Ms. Jacquelyn Taylor Cook for Coronado Vineyards Inc., in Willcox. Vice-Chairman Newman seconded the motion. Ms. Katie Howard advised the Board that since a permit had been issued, the Environmental Health department had withdrawn their previously filed objection and all reviewing departments now supported the issuance of the license and recommended approval. Supervisor Searle commented that the establishment would be a good addition to the Willcox area. Chairman Call opened the Public Hearing. No one responded and the Public Hearing was closed. Chairman Call then called for the vote and the motion carried unanimously.

ACTION

WORK SESSIONS (FUTURE)

ITEM 5-WORK SESSEION REQUEST TO DISCUSS USE OF CDBG FUNDS FOR LEAD HAZARD CONTROL IN COCHISE COUNTY IN THE 2007 AND 2009 FUNDING CYCLES Vice-Chairman Newman made a motion to hold the requested Work Session; Supervisor Searle seconded and the motion carried unanimously.

ITEM 6-WORK SESSION REQUEST TO REVIEW THE PROPOSED RURAL-RESIDENTIAL OWNER-BUILDER AMENDMENT TO THE INTERNATIONAL BUILDING CODE (IBC) RECOMMENDED FOR APPROVAL BY THE PLANNING COMMISSION AT THEIR MAY 10, 2006 PUBLIC HEARING. Vice-Chairman Newman made a motion to hold the requested Work Session; Supervisor Searle seconded and the motion carried unanimously.

STATE AND FEDERAL LEGISLATION

ITEM 7-STATE AND FEDERAL LEGISLATION: DISCUSSION, STRATEGY AND/OR GUIDANCE/DIRECTION ON CURRENT OR PENDING STATE OR FEDERAL LEGISLATIVE PROPOSALS/BILLS AND COCHISE COUNTY'S POSITION THEREON, TO INCLUDE: CSA LEGISLATIVE UPDATE; LPC MEETING ISSUES - INCLUDING STATE BUDGET; TNT; NEW LEVY LIMITS; CSA LEGISLATIVE PACKAGE; PILT; SECURE RURAL SCHOOLS ACT (COUNTY PAYMENTS) REAUTHORIZATION; STATE IMMIGRATION BILLS - Mr. Klein reported that he and Supervisor Searle had both participated in the County Supervisors' Association Legislative Policy Committee meeting the previous Friday and that the major concern and focus of the discussion had been the Truth-In-Taxation (TNT) proposals. He advised the Board that the bills are being heard this week and encouraged the Board members to talk to all of the county's representatives regarding the impact of the bills to Cochise County. He also pointed out that most of the smaller counties are not experiencing the growth that Pinal, Pima and Yavapai counties have had and therefore face a different situation. Supervisor Searle stated that CSA had come out with a good summary of the issues the prior week. The Board requested that Mr. Klein draft a letter on their behalf, stating the Board's position. Mr. Klein moved on to discuss the immigration bills, in particular HB2577 which requires the County Attorney to enforce the bill and contains a provision that indemnifies employers if the County Attorney makes a mistake. He stated that the unintended consequence, if this bill were to pass would be that the County Attorney would pass these types of cases to the State Attorney General's office. Another bill makes illegal immigration a criminal trespass; other bills propose some funding to deal with illegal immigration issues: one includes $50 million dollars over a period of two years for border radar, another would appropriate $30 million for "border security and detention" to border counties. Mr. Klein offered the opinion that he doubted if these bills would go very far. Supervisor Searle said he would be interested in the outcome of these and hoped that there would be money available for a jail.

SUMMARY ON CURRENT EVENTS BY STAFF AND BOARD MEMBERS:

ITEM 8-REPORT BY SUPERVISOR PATRICK CALL, DISTRICT NO. 1 - Chairman Call advised that he would be attending the Statewide Water Advisory Group with other Cochise County and Upper San Pedro Partnership (USPP) representatives on Friday; he announced that Carl Robie would be making a presentation to the group regarding the Upper San Pedro Basin and the Sierra Vista Sub-Watershed area, including Benson, and that they were working on the presentation. Chairman Call also congratulated the graduates of the University of Arizona South campus. REPORT BY SUPERVISOR PAUL NEWMAN, DISTRICT NO. 2 - Vice-Chairman Newman reported that he had been on a national teleconference regarding immigration policies the previous evening and was concerned about the potential National Guard presence in Cochise County. He added that he had attended the Douglas High School graduation ceremony and congratulated the graduates. REPORT BY SUPERVISOR RICHARD SEARLE, DISTRICT NO. 3 - Supervisor Searle reported that he would be going to Phoenix for a County Supervisors' Association meeting on Thursday; he stated that he felt it was critical to be there as the legislative proposals for the year are being finalized. He also said that he would be attending a J6 planning meeting in Benson Tuesday evening. He announced that the Benson High School Softball Team should be congratulated because they won the 2A State Championship this past weekend. Supervisor Searle also extended condolences to the family of Gerd Grombacher , who had formerly been a member of the FEMA Board and who passed away on Sunday. Chairman Call announced that a Special Board meeting would be held immediately following the Board meeting. There being no further business before the Board, Chairman Call adjourned the meeting.
