A regular meeting of the Cochise County Board of Supervisors was held at 02:00 P.M. on April 6, 2004 in the Bisbee South Road Yard Conference Room, 1237 Hereford Road, Bisbee, Arizona. In attendance were Patrick Call, Chairman; Leslie Thompson, Member; Jody Klein, County Administrator; Britt Hanson, Deputy County Attorney and Gussie Motter, Deputy Clerk of the Board. Supervisor Newman was absent due to illness.

Item 1-Adoption of Proclamation for Court Appointed Special Advocate (CASA) proclaiming April 1, 2004 as CASA Day in Cochise County, Arizona

Item 2-APPROVAL OF AN AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT FOR A WORKERS' COMPENSATION POOL WITH THE ARIZONA COUNTIES INSURANCE POOL TO CONTINUE THIS CONTRACT UNTIL JULY 1, 2014.

Item 3-APPROVAL OF MINUTES OF THE SPECIAL BOARD MEETING OF MARCH 30, 2004

Supervisor Thompson made a motion, seconded by Chairman Call, to approve the Consent Agenda, Items 1 through 14. The motion carried with two votes, Supervisor Newman being absent.

Item 15-APPROVAL TO TRANSFER UP TO $300,000 FROM THE GENERAL CONTINGENCY FUND TO THE INDIGENT DEFENSE ACCOUNT TO COVER EXPENSES TO THE END OF THE FISCAL YEAR.-Mr. Mike Politi, Legal Defender, explained that understaffing in the Legal Defender and Public Defender offices has resulted in more outside staffing and therefore, higher indigent defense costs. He projected potential possible savings of $322,017.62 if both departments were to be fully staffed. He also explained that there would always be a need for hiring independent counselors because of conflicts and occasional overloads in the system. In response to a question regarding the percentage of costs due to the County's relationship to the Mexican border, Mr. Politi stated that defending Port of Entry cases is down by roughly 90% because of the arrangement with the Federal Prosecutor in Tucson. However, he also remarked that in juvenile crime, 20% to 30% of the cases are a result of people who live in Mexico and come into Cochise County with criminal intent. Mr. Klein added that the actual amount spent on indigent defense contracts is down from last year but that the budgeted amount had not been increased from the previous year because it was hoped that more relief would be seen from Port of Entry cases. The increase in other crimes has simply overwhelmed the system. Supervisor Thompson made a motion, seconded by Chairman Call, to approve the transfer of up to $300,000 from the General Contingency Fund to the Indigent Defense account. The motion carried with two votes, Supervisor Newman being absent.

Health

Item 16-Approval of the new Lead Hazard Control Program - MOU between Housing Authority of Cochise County and the Cochise County Health Department-Mr. Bill Kammann, Director the Housing Authority of Cochise County, explained the Memorandum of Understanding (MOU) proposed between the Housing Authority of Cochise County and the Cochise County Health Department Adolescent Maternal and Child Health (AMCH). AMCH staff will provide outreach, testing, referral and education about lead poisoning hazards to families, with the target group being those children under the age of three years who live in Cochise County. The Housing Authority will provide $89,562 for this purpose. Supervisor Thompson made a motion, seconded by Chairman Call, to approve the new Lead Hazard Control Program MOU between the Housing Authority of Cochise County and the Cochise County Health Department and authorize the Director of the Health Department to sign. The motion carried with two votes, Supervisor Newman being absent.

Public Hearings

Assessor

Item 17-APPROVAL OF A CHANGE IN LEGAL CLASS FROM CLASS 4 TO CLASS 3, A REDUCTION IN ASSESSED VALUE, AND PRO-RATED TAXES PURSUANT TO A.R.S. 42-12054B FOR PARCEL 105-95-050 (DENT)-Mr. Phil Leiendecker, County Assessor, explained that the structure on this property was converted to owner occupancy in May of 2003 and that the requested change of class, reduction in assessed value, and pro-ration of taxes is correct. Chairman Call indicated that this was a public hearing and invited any member of the audience to address the Board. No one responded. The public hearing was closed. Supervisor Thompson made a motion, seconded by Chairman Call, to approve a change in legal class from class 4 to class 3, a reduction in assessed value, and pro-rated taxes pursuant to A.R.S. 42-12054b for parcel 105-95-050 (Dent). The motion carried with two votes, Supervisor Newman being absent.

Item 18

PETITION FOR REVIEW OF PROPOSED CORRECTION FOR PARCEL 121-15-001U (LATHAM)

Mr. Phil Leiendecker, County Assessor, explained that the initial Notice of Correction was issued because a structure was not included when the property was split. During the interim period, the Assessor's Office recommended a further reduction in value due to the physical condition of the structure. The Assessor and the property owners agreed to the following values:

Chairman Call indicated that this was a public hearing and invited any member of the audience to address the Board. No one responded. The public hearing was closed. Supervisor Thompson made a motion, seconded by Chairman Call, to uphold the recommendation of the Assessor in the case of parcel 121-15-001U (Latham). The motion carried with two votes, Supervisor Newman being absent.

Facilities/Solid Waste

Item 19-APPROVAL OF THE SOLID WASTE RATE FOR FY 04-05 TO $41.50 PER TON-Mr. L. H. Hamilton, director of Facilities and Solid Waste, explained that the Rate Review and Advisory Board has recommended the increase of $1.00 per ton to become effective July 1, 2004. The Rate Review and Advisory Board consists of the County Administrator and the City Managers of all of the County's incorporated cities, excluding Huachuca City. Each entity has one vote. Mr. Hamilton asked that the County do some PR so that citizens know that neither the Board of Supervisors nor the Facilities and Solid Waste Department have the authority to waive solid waste fees. The Solid Waste System gets only the money generated by tipping fees and receives no special County revenue. Chairman Call indicated that this was a public hearing and invited any member of the audience to address the Board. No one responded. The public hearing was closed. Supervisor Thompson made a motion, seconded by Chairman Call, to approve the new solid waste rate for FY 04/05 at $41.50 per ton and authorize the Chairman to sign. The motion carried with two votes, Supervisor Newman being absent.

ITEMS FOR DISCUSSION/GUIDANCE/POTENTIAL ACTION

Board of Supervisors

Item 20-FY 04-05 Budget Update - There was no report.

Item 21-State and Federal Legislation-Mr. klein announced that there was a Legislative Alert from CSA on a bill slated to go through the Senate Judiciary tomorrow. The bill stipulates that should there be a vacancy on the Board, the applicable party would, through its Precinct Committee, nominate three individuals from which the Board would chose a replacement. CSA will oppose the bill. Chairman Call remarked that Representative Burns has contacted him regarding HB 2141 dealing with military facilities. He urged interested parties to contact Representative Burns.

SUMMARY ON CURRENT EVENTS BY BOARD MEMBERS:

Item 22-REPORT BY SUPERVISOR PATRICK CALL, DISTRICT NO. 1

Supervisor Call spent two enlightening days shadowing workers in the Health department. He thanked the Health Department staff for their dedication and commitment. He also commented that Deputy County Attorney Britt Hanson has been an enormous help to the department-REPORT BY SUPERVISOR PAUL NEWMAN, DISTRICT NO. 2 - Supervisor Newman was absent due to illness.-REPORT BY SUPERVISOR LESLIE THOMPSON, DISTRICT NO. 3 - Supervisor Thompson did not make a report.

Item 23-REPORT BY PUBLIC INFORMATION OFFICER AND BOARD BROADCAST DIRECTION-Ms. Jensen will be recording a PSA next week to publicize the fact that the County offices have moved. A new map of the County complex will be posted on the web site. The next Board Broadcast will deal with the Cochise Combined Trust and the newest Wellness Program. There being no further business, Chairman Call adjourned the meeting. The next regularly scheduled meeting of the Cochise County Board of Supervisors will be held at 2:00 pm on Tuesday, April 13, 2004 in the Board of Supervisors Conference Room, 1415 Melody Lane, Building G.
